Payment & Cancellation Policy

These Payment and Cancellation Terms & Conditions apply to:

1. learners signing up for ALX Global programs;
2. all training courses and programs offered by African Leadership International (“ALI”).

By enrolling in a course or program, you agree to accept and be bound by these terms and conditions.

Payment Terms:

Fees

ALI reserves the right to amend the above-mentioned fees and/or run promotions in respect of the above-mentioned fees. Promotions will only be available to learners that are first-time registrants. Learners will be notified in the event of any pricing changes. Changes in pricing will not affect students that have registered prior to the notice of change in pricing.

Learners may choose to pay in one of the following ways:

1. Monthly subscription fees amounting to the full Retail Cost; or
2. Pay-in-Full, One-Time Payment offered at the rate reflected in the corresponding column above.

Monthly Subscription Payments

If a learner chooses to pay monthly, the first month’s fee will be paid at the point of registration.  Enrollment is not complete until ALI has received full payment of the first month’s fee. All subsequent payments are subject to the monthly billing cycle, which is 10 days prior to the first of the following month. Payment obligations in respect of Monthly Subscription Fees will cease if a learner withdraws from the program ahead of the next billing cycle. Payment confirmation will be emailed to the payer’s email address that is provided at the point of sale and for each billing cycle. It is the learner’s sole responsibility to follow up on whether payment has been received by ALI.

Pay-in-Full, One-Time Payments

If a learner chooses to pay the One-Time Payment, the Pay-in-Full One-Time Payment for the chosen program must be paid in full 14 days prior to the program start date. Enrollment is not complete untilALI” has received full payment of the associated program fees. Payment confirmation will be emailed to the payer’s email address that is provided at the point of sale. It is the learner’s sole responsibility to follow up on whether payment has been received by ALI.

Accepted Methods of Payment

ALX Global programs can be purchased using the following methods of payment: VISA, Mastercard, American Express, Discover, Apple Pay, Google Pay and PayPal. ALI reserves the right to update and or change payment methods at any time. In the event of any single payment option being discontinued, ALI will provide all learners with a 90-day notification before any changes take place. Learners may update their method of payment at any time.

Learners will be notified via email if a method of payment is no longer valid or where a payment fails. Where the payment method is invalid or where a payment fails, learners will have fourteen (14) days to rectify payment, failing which  access to ALI course materials and relevant learning platforms will be revoked.

Cancellation:

Cancellation by the Learner 

Learners providing notice of cancellation will be eligible for a refund, less a non-refundable administration fee according to the timelines outlined below.

No refunds are available after the timeframes mentioned below. Learners wishing to withdraw, should consider the timelines outlined below.

Pay-in-Full, One-Time Payment Cancellations

Learners providing notice of cancellation on or before the start date, or within the first fourteen (14) days of the program start date are eligible for a refund of the Pay-in-Full, One-Time Payment paid up to that point, less a non-refundable administration fee of $150.

Subscription Payments

Learners providing notice of cancellation on or before the start date of the program or withing the first seven (7) days of the program start date, are eligible for a refund of the first monthly Subscription Payment less a non-refundable administration fee of $150.  

Cancellation/Rescheduling by African Leadership International

ALI may at its sole discretion cancel or reschedule any program for any reason, including at the occurrence of a Force Majeure Event  (which includes, but is not limited to any event that is not in ALI’s control that prevents any course or program from being delivered or completed). ALI will attempt to provide at least seven (7) business days’ notice when canceling or rescheduling. However, programs may be canceled or rescheduled without warning.

Program fees paid up to the point of cancellation or rescheduling will be refunded to enrolled learners if the delivery or completion of a course or program is affected by a Force Majeure event.

If a course or program is canceled or rescheduled for any reason other than a Force Majeure event, ALI will at the learner’s request, refund the fees paid for the canceled program or credit the fees toward the fees chargeable for a rescheduled program.

Substitution of Learners:

Substitutions of one learner for another for any single program and or course are NOT accepted. 

Disclaimer and Limitation of Liability:
No warranty

ALI MAKES NO REPRESENTATION OR WARRANTY ABOUT THE ALX GLOBAL PROGRAMS OR THE PAYMENT METHODS MENTIONED HEREIN, INCLUDING ANY REPRESENTATION THAT THE COURSES OR PAYMENT METHODS WILL BE UNINTERRUPTED OR ERROR-FREE. WE PROVIDE THESE SERVICES (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ALI, NOR ITS DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS AND/OR AFFILIATES WILL ASSUME ANY LIABILITY FOR ANY CLAIMS, COSTS, DAMAGES OR LOSSES INCURRED OR SUFFERED BY ANY LEARNERS AS A RESULT OF:

1. a program being canceled or rescheduled for any reason;
2. failed payments;
3. any learner’s failure to confirm receipt of payment by ALI;
4. payments made using incorrect banking details;
5. any learner’s misconduct, misrepresentation, negligence, or provision of inaccurate information;
6. any action or omission by a third party.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALI, INCLUDING ITS DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS AND/OR AFFILIATES, WILL NOT BE LIABLE IN CONNECTION WITH THESE TERMS FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.

ALI, INCLUDING ITS DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS AND/OR AFFILIATES WILL NOT BE LIABLE TO LEARNERS IN CONNECTION WITH THESE TERMS FOR ANY AMOUNT THAT EXCEEDS THE TOTAL FEES PAID OR PAYABLE BY YOU TO ALI FOR THE SERVICES/PROGRAMS.

Indemnity:

Learners hereby agree to indemnify, defend and hold harmless ALI, its directors, employees, contractors, partners and/or affiliates from and against any third-party claims, demands, losses, expenses (including reasonable legal fees) arising from:

1. your enrollment in any of the ALX Global programs;
2. your violation of these terms;
3. your violation of any rights of a third party.

Governing Law & Jurisdiction:

Regardless of your country of residence, ALI and the learners agree that the laws of Mauritius, excluding conflict of laws rules, shall exclusively govern any dispute relating to these terms.

Learners and ALI agree that claims and disputes can be litigated only in Mauritius, and ALI and learners each agree to personal jurisdiction in those courts.

Other Important Terms:

If a court with authority over these terms finds any part of it unenforceable, the court may modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, learners and ALI agree to ask the court to remove that unenforceable part and still enforce the rest of these terms.

These terms (including additional terms that may be provided by ALI when learners engage ALX Global programs) is the only agreement between learners and ALI regarding the ALX Global programs and supersedes all prior agreements for these programs.

If ALI does not act to enforce a breach of these terms, that does not mean that ALI has waived its right to enforce these terms. 

Learners may not assign or transfer these terms (or participation in the ALX Global programs) to anyone without ALI’s prior consent. However, learners agree that ALI may assign these terms to our affiliates or a party that buys it without your consent.
